Supreme Court Restores Criminal Proceedings for Child Pornography Storage

Supreme Court

Supreme Court

The Supreme Court set aside a Madras High Court judgment that ruled storing child pornography without intent to share was not an offence. The apex court emphasized that failing to delete or report such material indicates an intent to transmit. The ruling strengthens the enforcement of Section 15 of the POCSO Act, ensuring child welfare. The court also urged Parliament to amend the term ‘child pornography’ to ‘child sexual exploitative and abusive material.’
